1. Who we are

These Terms & Conditions ("Terms") govern your use of the QR Code Generator with touch option service (the "Service") provided by Kevin Gipson LLC("we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Acceptance & authority

By continuing to use the Service you confirm you are of legal age and, if using it on behalf of an organization, that you have authority to bind that organization.

3. The Service

The Service lets you generate QR codes, including our "touch option" variant, from URLs or text you provide. Features are offered on a credit / plan basis as described on our pricing page.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for unlawful, fraudulent, or deceptive purposes;
  • send spam, phishing links, or malware through QR codes generated with the Service;
  • infringe intellectual property, publicity, or privacy rights of others;
  • probe, scan, scrape, or interfere with the security or integrity of the Service;
  • attempt to reverse engineer, resell, or redistribute the Service.

5. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

Kevin Gipson LLC retains all right, title, and interest in the Service, including its software, branding, and documentation. You are granted a limited, non-exclusive, non-transferable right to use the Service within your selected plan. QR codes you generate from your own content remain yours.

7. Payments, billing, taxes & refunds

Payments are processed by our payment provider, Stripe. Kevin Gipson LLC is the seller of record. See our Refund Policy for details on refunds and cancellations. Applicable taxes may be added at checkout.

8. Service availability

We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension & termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination your right to use the Service ends immediately.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify Kevin Gipson LLC against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Kevin Gipson LLC is established, without regard to conflict-of-law principles.
